1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the Wiggins Homestays website at wigginshomestays.com and any services we provide through it. By using the site, you agree to these Terms. If you do not agree, do not use the site.

2. Who we are

Wiggins Homestays is a short-term rental management company based in New Braunfels, Texas. We operate a small portfolio of vacation rentals along the Guadalupe and Comal Rivers and provide boutique management services to a limited number of luxury property owners in the Texas Hill Country.

3. Using this site

You must be at least 18 years old and able to form a binding contract to use this site for bookings or inquiries. You agree to provide accurate, current, and complete information when submitting the owner assessment, contact forms, or booking requests. You are responsible for the activity that takes place under any account or phone number you provide.

4. Bookings and reservations

The rental listings on this site are a general description of each property. Any booking you make is a separate rental agreement between you (the guest) and the property, subject to additional rental terms, house rules, security deposit, cancellation policy, and applicable fees. Those terms are provided at the time of booking.

All reservations are subject to guest verification, which may include identity checks, background screening, and reservation review. We reserve the right to decline or cancel a reservation that does not meet our guest standards or that we reasonably believe presents a risk to the property, guests, or neighbors. Direct bookings are not automatically confirmed. A reservation is confirmed only when you receive written confirmation from us or our booking platform after verification is complete.

If you book through a third party such as Airbnb or Vrbo, that platform's terms and cancellation rules also apply.

5. Property management inquiries

The owner assessment at /management is an informational tool only. Completing it does not create a management agreement or any other contract between you and Wiggins Homestays. A management engagement only begins when both sides sign a written property management agreement.

6. Content and intellectual property

The website content, including property photos, descriptions, logos, blog posts, and page layouts, is the property of Wiggins Homestays or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and share links to our pages for personal or editorial use. You may not copy, republish, redistribute, or use our content for commercial purposes without our prior written permission.

If you submit a review, testimonial, photo, or other content to us, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business and marketing, with appropriate attribution where practical.

7. Things you agree not to do

  • Use the site to send spam, scrape data at scale, or circumvent security measures.
  • Submit false, misleading, or impersonating information through any form on the site.
  • Reverse engineer, copy, or frame the site to suggest affiliation we have not authorized.
  • Use the site in any way that violates applicable law, infringes intellectual property rights, or could damage our reputation or operations.

8. Third-party services

The site links to and integrates with third-party services such as Airbnb, Vrbo, Hospitable, Google, MarketMySTR (GoHighLevel), Stripe, Mailgun, and others. We do not control those services and are not responsible for their content, availability, pricing, or terms. Your use of a third-party service is governed by that service's own terms and privacy policy.

9. No warranties

The site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, and accuracy of information. Rental descriptions are prepared in good faith and may contain errors; always confirm availability, pricing, and specific property features in writing before relying on them.

10. Limits on our liability

To the maximum extent permitted by applicable law, Wiggins Homestays, its owner, staff, and contractors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to your use of the site, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the site or these Terms is limited to the greater of one hundred U.S. dollars or the amount you paid us directly during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence, fraud, or willful misconduct.

11. Indemnification

You agree to defend, indemnify, and hold harmless Wiggins Homestays and its owner, staff, and contractors from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the site, your violation of these Terms, your violation of applicable law, or your infringement of a third party's rights.

12. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the site will be brought in the state or federal courts located in Comal County, Texas, and you consent to the personal jurisdiction of those courts. If any part of these Terms is found unenforceable, the rest will remain in effect.

13. Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Effective" date at the top. Continued use of the site after changes take effect constitutes acceptance of the updated Terms.
